GTO Wizard API & Leaderboard Terms of Service

PLEASE READ THESE TERMS CAREFULLY.

These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and GTO Wizard ("Company," "we," "us," or "our"). These Terms govern your access to and use of the GTO Wizard Benchmarking API, documentation, and the associated public leaderboard (collectively, the "Service").

BY GENERATING AN API KEY OR OTHERWISE ACCESSING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.

1. DEFINITIONS

  • "API Key" means the unique, static cryptographic credential generated by User to authenticate access to the Service.
  • "Authorized Purpose" means the strict use of the Service to connect a poker software agent to the Company's environment to play poker hands for the sole purpose of performance benchmarking.
  • "Benchmarking Data" means the specific hand histories, win-rates, decision logs, and statistical metrics generated during the interaction between Your Agent and the Company AI.
  • "Company AI" means the proprietary poker strategy artificial intelligence developed and owned by GTO Wizard.
  • "Your Agent" means the software, code, or bot employed by you to interact with the Company AI via the API.

2. API ACCESS AND SECURITY

2.1 License Grant

Subject to your strict compliance with these Terms, Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the API solely for the Authorized Purpose.

2.2 Static API Keys & Security

You acknowledge that the Service relies on static API Keys for authentication. You bear the sole burden of security for your API Key.

  • Confidentiality: You agree not to share, publish, or embed your API Key in public repositories (e.g., GitHub) or client-side code.
  • Liability: You are fully responsible and liable for all activities that occur under your API Key, regardless of whether such activities were authorized by you. The Company assumes that any request made with your API Key is a request made by you.
  • Compromise: You are responsible to contact us at [email protected] if you believe your API Key has been lost, stolen, or compromised.

3. DATA RIGHTS AND PUBLIC LEADERBOARD

3.1 Public Nature of Benchmarking

You acknowledge that the Service is a public benchmarking platform. There is no expectation of privacy regarding Your Agent's performance.

3.2 License to Benchmarking Data

By using the Service, you grant Company a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid-up license to:

  • Publicly Display: Publish Your Agent's name, rank, Benchmarking Data, and full hand histories on the Company's website, leaderboard, and marketing materials.
  • Analyze & Improve: Use Your Agent's gameplay patterns to analyze, debug, train, and improve the Company AI and related products.

3.3 Ownership

  • Company Property: Company owns all rights, title, and interest in the Service, the Company AI, the API structure, and the aggregated Leaderboard data.
  • User Property: You retain ownership of the source code and proprietary algorithms of Your Agent.

4. PROHIBITED CONDUCT AND ANTI-ABUSE

4.1 Data Mining and Model Extraction

You represent and warrant that you will not use the Service to:

  • Scrape, harvest, or systematically query the API to extract the underlying strategy, decision trees, or "GTO" solutions of the Company AI.
  • Use the Benchmarking Data to train, fine-tune, or calibrate any third-party artificial intelligence or poker solver (i.e., "Model Distillation").

4.2 Fair Play and Integrity

  • Autonomous Play: Your Agent must operate autonomously. Human assistance during active hands ("Centaur" play) is strictly prohibited and constitutes a material breach of these Terms.
  • Manipulation: You shall not reverse engineer the API, manipulate timestamps, or exploit software vulnerabilities to artificially inflate Leaderboard rankings.

5. SUSPENSION AND TERMINATION

5.1 Termination by Company

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms.
  • Excessive usage that burdens our infrastructure (DDoS or rate-limit evasion).
  • Any suspicion that your API Key has been leaked.

5.2 Effect of Termination

Upon termination, your license to use the API is immediately revoked. However, the license granted to Company regarding Benchmarking Data (Section 3.2) shall survive termination, and your Agent's historical results may remain on the Leaderboard at Company's discretion.

6. DISCLAIMERS AND WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

COMPANY DOES NOT WARRANT THAT: (A) THE API WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE LEADERBOARD RESULTS ARE ACCURATE OR TAMPER-PROOF; OR (C) THE COMPANY AI PLAYS A PERFECT OR UNEXPLOITABLE STRATEGY.

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Company, its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your Agent's infringement of any third-party intellectual property rights.
  • Your violation of these Terms.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE API.

IN NO EVENT SHALL COMPANY'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID COMPANY, IF ANY, IN THE PAST TWELVE MONTHS FOR THE SERVICE.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Governing Law

These Terms shall be governed by the laws of the Czech Republic, without regard to conflict of law principles.

10. GENERAL PROVISIONS

  • Modification: We reserve the right to modify these Terms at any time. Continued use of the API after changes constitutes acceptance.
  • Severability: If any provision of these Terms is held invalid, the remaining provisions shall continue in full force.
  • Entire Agreement: These Terms constitute the entire agreement between you and Company regarding the Service.
